On promulgating a Program to cut and simplify regulations related to business activities in the period of 2020 - 2025
Pursuant to the Law on Organization of the Government of June 19, 2015;
Pursuant to the Government’s Decree No 138/2016/ND-CP dated October 01, 2016 on promulgating the working regulation of the Government;
At the proposal of the Minister and Chairman of the Government Office.
To promulgate a Program to cut and simplify regulations related to business activities in the period of 2020 - 2025 (hereinafter referred to as the Program) with the following contents:
I. DIRECTION VIEWPOINTS
1. To take enterprises and people as the center, the driving force for socio-economic development of the country; promote and create the favorable conditions for enterprises and people to participate in business activities; reduce time and cost for enterprises and people in complying with regulations related to business activities.
2. To immediately cut and simplify unnecessary, unreasonable and illegal regulations, which are barriers and difficulties for business activities of enterprises and people in the current documents, thus contributing to the improvement of effectiveness, efficiency and assurance of objectives of state management, promoting enterprise development.
3. To ensure the publicity and transparency; promote the role of heads of state administrative agencies at all levels in the reform of regulations related to the business activities.
4. To ensure compliance with international treaties to which Vietnam is a party, including free trade agreements to which Vietnam has acceded.
II. OBJECTIVES, REQUIREMENTS AND SCOPE OF IMPLEMENTATION
a) During the 2020 - 2025 period, to cut and simplify at least 20% of existing regulations as well as 20% of the cost of compliance with regulations relating to business activities in currently effective documents until the end of May 31, 2020, which are listed and calculated (calculate the cost of compliance and first publish) by the ministries and agencies (before October 31, 2020); at the same time, to minimize the number of current documents with regulations related to business activities under the jurisdiction of ministers, heads of ministerial-level agencies, the Prime Minister and the Government.
b) To strictly control the promulgation of documents with regulations related to the business activities in accordance with law regulations, especially administrative documents, circulars of minister and heads of ministerial-level agencies, decisions of the Prime Minister and decrees of the Government. To prevent the emergence of unnecessary, unreasonable and illegal regulations, which are difficulties for business activities of enterprises and people.
a) To define specific work contents, deadlines, expected completion products and responsibilities of relevant agencies; to ensure quality, efficiency, on time, publicity, transparency, and compliance with law regulations in the implementation of the Program's tasks.
b) When cutting and simplifying regulations related to business activities, benefits for businesses, citizens and society must be quantified, without adversely affecting their operations, legitimate rights and interests; to ensure the goal of state management, not creating a legal vacuum in the law.
c) To fully comply with Clause 3, Article 11 of the Law on Promulgation of Legal Documents when issuing documents detailing and guiding regulations related to business activities in the direction of encouraging the integration of many contents into a document to minimize the number of detailed documents, ensuring consistency and facilitate the implementation and compliance with the law.
d) To request the competent agencies for permission to apply the form of one document amending many other documents when issuing a document amending, supplementing or replacing current documents related to the business activities for the purpose of cutting and simplifying regulations related to business activities (except for documents regulating complicated and sensitive issues related to national security, social order and safety).
